Justice for Shadow and Poppy Petition

justice for animals - 14 Apr 2004 16:14 GMT ------------------------------------------------------------ Please forward on to whoever you can. The law need to start recogizing the seriousness of this type of crime. The man (allegedly) doused his two puppies with WD-40 and lit them on fire. It took two weeks for his crime to be discovered, during which time no medical attention was given to the puppies. Hi Everyone, I know, another petition. I saw this on the news last night and it was very upsetting. I asked one of our volunteers (Lisa) to put together this petition so our voices can be heard. Please take ONE minute to sign it. Our goal is to reach 2000 signatures. Also, please send it to all your friends on line. Lisa will send all the petitions to the acting Prosecutor. perhaps a petition alone isn't enough, but it gets the word out. if you think it is not enough, and you care, then contact the authorities directly. many have done this. i think the public outcry *is* having an effect. Ocean County, NJ courts have let people off pretty easy in the past for animal abuse. Initially, this guy's bail was set at $5000, and he went home. Today, as reported in the Asbury Park Press, the judge increased his bail to $50,000 and threw him in jail.

so your (online) voices *can* make a difference, even if it is just to get the word out to let the authorities know that we are paying close attention to how they handle these cases.
the petition is going to be sent to the court, and it may make a difference at sentencing time, if the judge thinks that the whole world is scrutinizing his decision, rather than just a few people in the courtroom.
please reconsider your position on this issue, not only for this case, but in general. you *can* make a difference.

The problem remains that there is too much padding that's possible, and a list of 2000 email addresses is something that can and will be considered arbitrary. I can create an infinite number of email addresses on my computer here, pretend they're all my (l)users, and sign the petition with each of those addresses. Your count will go to 2000 in a heartbeat, but it'll count for nothing because, QED, I can pad the dataset with garbage, and if I can pad it, so can anybody else - including the petitioner. With no validation mechanism (in this case, a validation mechanism would be PGP/GPG signatures or something similar collected with the email addresses), the data is spectacularly useless to anybody but a marketing firm.
I hate to sound callous, then, but there is really nothing to reconsider. You are certainly wise to get the word out on this and raise Cain about it, and God's blessings to you for that, it needs to be done - but an OLP won't work for a hill of beans if I want something done. You gotta write your congresscritters. If I want laws to change or otherwise raise concerns with federal government, Rep. Loretta Sanchez' office is walking distance from my home, and Sen's Dianne Feinstein and Barbara Boxer are but a mailbox and three days away - and if I want to go to the state, well, somehow or another, writing a letter to Arnold "The Governator" Schwarzenegger up in Sacramento just seems kinda cool. =^^=
And that, sir, is precisely what I have done. Now what they can do for some random furry fan with cats is left as an exercise to the reader, but I think the answers are in the questions raised.

abuse is possible with an online petition. filling out all the fields with verifiable information adds to the credibility of the petition. it is technically possible to limit on signature per ip address, but i don't know if they do that. most responsible adults who take these matters seriously do not resort to such juvenile activity.
>I hate to sound callous, then, but there is really nothing to reconsider. >You are certainly wise to get the word out on this and raise Cain about [quoted text clipped - 10 lines] >some random furry fan with cats is left as an exercise to the reader, but >I think the answers are in the questions raised. there are two separate points of law, here, the law itself, and enforcement, prosecution, and sentencing. you are addressing one (contact the legislators), but not the other, which is the point of this matter. there is discretionary power within the prosecutor's office as to what charges are brought, whether plea agreements are on the table, and what the prosecutor asks of the judge. public pressure does affect this process, and it seems to be working in this case because the prosecutor changed what he asked of the judge (to increase bail high enough to keep him incarcerated), and the judge granted the request. in many cases of actual animal abuse, the prosecutor only charges the offender with a 'disorderly person' charge, not even animal abuse. it is this part of the process that we are trying to influence. any law, not matter how strict, is useless if it is not enforced and properly applied.
if you would prefer to spend an hour debating the issue on the usenet, rather than spending one minute to sign the petition in the hope that you will make a difference, then that is up to you. you surely will not make a difference in *this case* with your proposed course of action.
