Hung Jury

I can't believe it!  A portion of the quote in the paper tonight says:

One juror simply refused to consider whether two brothers were guilty
of.......

.... "When they won't even deliberate, it's insane," said District Attorney
Paul Howard. "It's really bad that someone would come to a jury deliberately
to sabotage a case."

A retrial was immediately set for January 3rd.  Disregarding the cost to
taxpayers, now the participants have to listen to this all over again.

I'm sorry, Chak, I mentioned it in a post earlier this week. This is an
animal cruelty case in Atlanta, GA. I'm not sure if you can get to the url
but it is at www.ajc.com.  You can also see my earlier post under a thread
titled "Jury Purrs"

And what about alternates?  Don't juries have alternates just in case
something happens to one or two jurors?

In all the times I've had jury duty, I've only known of one jury that had
alternates.  In that case, I was the only alternate.  In any case, the
alternate(s) never get inside the jury room, so they wouldn't have any
effect on a hung jury.

That system doesn't make any sense to me.  Here, the alternates sit in
the jury box, hear all the evidence, and are treated in general exactly
like a juror, except that the vote only counts if one of the regular
jurors can't (for whatever reason) vote.  

Or do you mean that they hear all the evidence, they just aren't allowed
to sit in on the discussion?

Juries sometimes have alternates, but there are often none if it is expected
to be a very short trial.  I'm also not sure what happened here.  Did these
jurors simply dig in their heels and say they think the state didn't prove
guilt?  If so, you can't bring in alternates in order to avoid a hung jury.
That would create juries predisposed to convict.  Or did they *literally*
refuse to look at the evidence?  In that case, judges occasionally remove a
juror and use the alternates (when available).

that is bad, the brothers admitted didn't they? there is untold
evidence to prove they did it anyway so what is the problem in finding
them guilty? dos the juror think that the boys were just 'playing' and
that they didn't mean to hurt the puppy or something totally retarded
liem that? does this juror think that the boys put him in the oven for
a laugh and honestly had no idea that the poor thing woudl be cooked to
death? whether they knew what the result of their actions would be is
irrelevant, they did the deed and should be punished for it and
certainly if they did it without realising the harm they would cause is
even more reason to lock them away for the good and safety of the
general public.
what will they do next if they are not locked up and the key thrown
away?
absolutely f.cking insane
is there anything we can do? write letters to anyone or anything? lobby
anyone?

I knew I should not have read the story but I did.  How nice!  I wonder how
the "hung" juror would like a demonstration of just how this poor dog felt.  
Does anyone doubt if these pieces of turd get off we will hear from them
again in an even more serious scenario (maybe a human infant would be
fun!).  What the hell does it take for some people to stand up and do the
right thing.  As a race and a people we can be pretty pitiful.  I am sick
at what these two did to this defenseless animal and none too thrilled at
what I would like to do to them in return.
