I'm really sorry that the creep (and the irresponsible people who let
the creep do it) ruined your holiday. :(

They did... and we withdrew a bunch of money and put it into a savings
account to keep it safe... what we didn't know was that the fake
charges were going to clear anyway, so THAT money was taken out of the
account as well, leaving a decidedly UNpretty sight :( John fixed most
of it today and we'll get the money back eventually, but things are
going to be very lean until we do. Really the biggest annoyance about
it all (aside from all the stress) is that John had to take one of his
precious vacation days and spend most of it at the bank! Grrr....

So in the letter in which you demand satisfaction in writing (which of
course, you must do and get EVERYthing in writing from the bank too),
you will include not just:
- replacing the money that was fraudulently withdrawn
- the restoral of any overdraft fees they may have automatically charged
- letters of explanation and apology to all vendors where checks were
incorrectly returned NSF
- honoring the checks to those vendors that they bounced
...but also a day's pay (gross, not net) for John's time. Right?

That's terrible! Why would the bank pay those charges when they *already
knew* they were fraudulent? It's not like the money was already gone. How
stupid is that??

I understand where you're at, though. Many years ago, just after
relocating from So Ca to Texas, I had a similar experience. Except
this time it was the bank itself who screwed up. Some teller in
Houston entered the wrong account number for a BIG withdrawl and
cleaned me out. Unfortunately, I had my savings account tied to my
checking (REALLY BAD IDEA!!!) so it sucked EVERYTHING out. I had to
scream bloody murder to get it fixed in a week or so and then the dumb
sh*ts credited the wrong account number. In the meantime, I was
running around trying to deal with bounced checks. Luckily, I had
some new friends who loaned me grocery money but what a mess. I never
did get them to refund the bounced check charges. I just changed
banks and made sure they knew exactly who and why.

I don't think you need to worry about not having a remedy in this
situation. In most states, the agency relationship between you and
your bank is governed by Article 4 of the Uniform Commerical Code.
I've usually found it to be a very simple and consumer-friendly set of
standard statutes. You can see it here, for example:

Generally, when your bank is at fault and causes you to bounce checks
and/or suffer other types of damages, the bank is liable by statute
for all of it.
UCC 4-402(b): "A payor bank is liable to its customer for damages
proximately caused by the wrongful dishonor of an item. Liability is
limited to actual damages proved and may include damages for an arrest
or prosecution of the customer or other consequential damages. Whether
any consequential damages are proximately caused by the wrongful
dishonor is a question of fact to be determined in each case."

A) Don't worry about the Christmas cards. I'd be happy to receive on in July
or even later (or even never)... because
B) Christmas isn't about cards, or presents. Leaving any religious
observation aside for the moment, Christimas is about spending time with
loved ones. Don't let the b*st*rds ruin Christmas for you, make it the best
Christmas you've ever had *despite* them. Observe the *spirit* of Christmas,
even if you can't do the usual things this year. I hope you can feel the
warmth & love of the cards that you will receive (freely, btw, they aren't
given because we expect to get one in exchange) and know that, no matter
what crappy things are going on in your life, that you are both dear friends
and indeed loved by many.

Hi Karen,
Have you contacted the Attorney General for Florida yet? Here is a
link to the ID theft website: http://myfloridalegal.com/identitytheft
- they have lots of info on there. I would definitely complain to the
highest level of the bank, and the jewelry store where the transaction
took place. They may have video of who ever used that card/number. You
should report it to the police if you haven't already done so. Call
up your local newspaper and see if they are interested in the story -
you never know, and the more heat you can give the bank the better!
