Karen AKA Kajikit - 05 Dec 2006 15:28 GMT Now we've been doubly screwed... by the person who tried to take our money, and the bank person who told us that it was all taken care of on Saturday. They lied through their teeth.
The charges went through last night so this morning we woke up to a negative bank balance (because we moved the largest part of our funds into a savings account on saturday to protect it from any further theft attempts) and five bounced checks (because we left our rent and grocery money in the original account and spent it as it was intended).
I want to kill someone very badly.
John's just gone to the bank to try and fix it but they said it will take a week to untangle the mess and he has to do a formal affidavit and fill out a bunch of paperwork. I didn't go with him because if I did it's certain that I'd end up banned for life if not arrested, because I'd give them a piece of my mind VERY loudly. Why did they lie to us on Saturday? We could have done what we needed to do then... or at least at nine o'clock yesterday morning. We wouldn't have bought groceries and I'm sure that our landlord would have agreed to hold off on the rent for a week or so under the circumstances... but the bank just let us jump into the hole that was dug for us, and all they're waiting to do now is to shovel the dirt in after us. :(
Karen - 05 Dec 2006 15:36 GMT The bank should be responsible for any bounced checks in this circumstance. It may take a while to fix the mess, but you can't be held responsible if the bank told you to do it. Mega purrs coming. This really does suck :(

The level of incompetence that some organizations can achieve is mind boggling. I hope you get this all straight very soon. Try no to let them get you down.

That really stinks. I hope the bank gets its act together and straightens out the mess soon, with no extra fees!

(You might post a warning to others letting them know which bank it is, too.) Might be worth it to consult an attorney - sounds to me as though the bank might well be at fault in allowing access to your account without a signature or PIN!

Believe me, the millisecond that money goes back in our account it's ALL coming out again! The name of the bank starts with W M and I'm sure you know which one it is... I was just venting about it over on IRC and at least four out of the 20 people in the channel have been screwed over by them in some way too!
BTW, when the person (presumably a guy since it was DH's name on the account) used the card, he signed for his purchases.

Ollie - 06 Dec 2006 16:08 GMT And I was just thinking how lucky I was to get my problem straightened out so quickly. And I have the same bank. I guess it helps when the people use the card number to pay their electric and cable bill. Calls to the electric company and cable company had those charges put right back in our account.

I've always heard good things about them (if they are who I think they are). Some friends of mine have accounts there and they've been happy with that bank, so I hate to think that something like this could happen to them.

PS - After hearing your story, I went to my bank and asked what kind of protection I'd have if someone used my debit card number to clean out my account. They told me it was very similar to how it would be handled with a credit card, ie, I can dispute it, they would investigate, etc - except, of course, that the thieves would have taken actual money rather than "promised" money. There would be a period where I would be out of cash... but the guy at the bank said they'd resolve it within 10 days.

And that is why I don't keep a lot of cash in my checking account. Also don't have an EFT card. Just an ATM card where I have to enter a code to use it. With nearly everyone accepting credit cards anymore I'm not sure I really even want to have that.

With a credit card, you can refuse to pay a disputed charge - they may charge interest on the unpaid balance if the dispute is not resolved, but usually they'll just remove the charge from your account and shoot it back to the vendor. (And of course, no one can use my ATM card without the PIN.)

But NOT the signature they have on file for your husband, right? (That's the purpose of signature cards - so you can prove it, if someone else tries to write checks on your account.)

Could the person who stole your identity to begin with have been employed by or have contact with anyone you applied to for a mortgage? It sure seems too much of a coincidence that this happened a week after you were trying to get a loan for a house! Good luck that this is all sorted out within the next 24 hours.

We never sent the loan application paperwork in... I really don't think it's connected. I think it's more likely that one of the (few) people we had dealings with on our trip to Tampa last month swiped the information...

And yes, it was a nightmare to straighten it all out. This happens so often now, you would hope that the banks would be able to handle it better.
